How does ETIAS relate to DSGV

ETIAS is a concept for future entries into the Schengen area. The reader must always be aware that many statements here are subject to reservation. Regulations can change and then ETIAS has to adapt to the changed conditions. However, travellers can assume that ETIAS always complies with existing laws. This also applies to the processing of data. Here we have the Data Protection Basic Regulation (DSGVO).

What exactly does the basic regulation on data protection mean for travelers to the Schengen area

 The DSGVO aims to ensure uniform data processing in the EU. This regulation has been in force since 25 May 2018 and replaces the previous data processing regulation.

In total, the DSGVO consists of eleven chapters and 99 articles. Article 6 is of particular importance, as it regulates that Internet users must give their consent to data processing.

The following data are expected to be collected by ETIAS

 Until now, a passport has been sufficient for most tourists to the Schengen area. After the introduction of ETIAS, the applicant has to provide a whole range of data. The traveler must take the personal data from the passport. Accurate work is necessary here, because a mistake will invalidate ETIAS. Since the passport does not have to be submitted, the application is first approved. When the passport is checked at the airport, it is noticed that the data do not match and the entry is not approved.

In addition to the personal data, the traveler must also specify the first country he or she enters. Presumably, information about existing previous illnesses and personal settings are still required. It is to be expected that ETIAS will follow the similar ESTA procedure in the USA.

 How the data is processed

Without the traveler noticing anything, the data is compared with the European databases. Among other things are available:

- The Schengen Information System

- The Visa Information System

- The Europol data

- The Eurodoc database

- Interpol's database of lost and stolen travel items

In addition, an entry/exit system and other databases will be established.

ETIAS is DSGVO compliant

 Of course, only after ETIAS has been established can a final statement be made as to whether the system complies with European data law. However, it can be assumed that it does. After all, it is a state system. If it does not comply with the existing laws, who does?
